These Terms and Conditions ("Terms") govern your use of the MemoryTales website at memorytales.co.uk and the purchase of our personalised children's storybooks. By placing an order or using our service, you agree to be bound by these Terms.

MemoryTales Ltd is a company registered in England and Wales. Our contact email is contact@memorytales.co.uk.

1. Use of Service

MemoryTales provides a service that allows customers to create personalised, illustrated storybooks for children using uploaded photographs and customisation options.

  • You must be at least 18 years of age to place an order through our service.
  • By placing an order, you confirm that you have the legal authority to enter into a binding contract and that all information you provide is accurate and complete.
  • You are responsible for ensuring that any photos you upload are of individuals for whom you have the legal right to share their image (e.g. your own children or children for whom you have parental or guardian consent).
  • You agree not to upload any content that is unlawful, offensive, or infringes upon the rights of any third party.

2. Orders and Personalised Products

All products sold through MemoryTales are personalised and made to order. Each book is individually created based on the photos, names, and story preferences you provide.

  • An order is placed when you complete the book creation process and submit payment. Your order is confirmed upon successful payment processing.
  • We reserve the right to refuse or cancel any order if we reasonably believe the content submitted is inappropriate, unlawful, or otherwise unsuitable for production.
  • Once an order has entered production, it cannot be modified or cancelled, as the personalisation process begins immediately upon order confirmation.
  • We will make every reasonable effort to ensure the quality and accuracy of your personalised book. Minor variations in colour between screen display and printed product are normal and do not constitute a defect.

3. Pricing and Payment

  • All prices are displayed in British Pounds (GBP) and are inclusive of VAT where applicable.
  • The total price shown at checkout includes the cost of your book and any applicable delivery charges.
  • Payment is processed securely via Stripe. We accept major debit and credit cards. We do not store your full card details on our servers.
  • Your order is confirmed only upon successful payment. If payment fails, no order will be placed and you will be notified.
  • We reserve the right to change our prices at any time. Any price changes will not affect orders that have already been confirmed.

4. Delivery

  • We currently deliver to addresses within the United Kingdom only.
  • Orders are dispatched via our print and delivery partner. Estimated delivery is 7–14 working days from the date of order confirmation, which includes production time.
  • Once your order has been dispatched, you will receive a shipping confirmation email with tracking information.
  • Delivery times are estimates and not guaranteed. We are not responsible for delays caused by our delivery partner or circumstances beyond our control.
  • Please ensure that your shipping address is correct and complete. We cannot be held responsible for orders delivered to an incorrect address provided by the customer.
  • If your order has not arrived within 15 working days of dispatch, please contact us and we will investigate with Royal Mail.

5. Intellectual Property

  • All content on the MemoryTales website, including but not limited to text, graphics, logos, page layouts, and software, is the property of MemoryTales Ltd and is protected by UK and international copyright and intellectual property laws.
  • The illustrations created for your personalised book are owned by MemoryTales Ltd. You are granted a personal, non-commercial licence to enjoy the illustrations as part of your purchased book.
  • You retain all rights to the photographs you upload. By uploading photos, you grant us a limited, temporary licence to use them solely for the purpose of creating your personalised book.
  • Story templates, narrative structures, and the MemoryTales brand are proprietary. You may not reproduce, distribute, or create derivative works from our content without written permission.

6. Acceptable Use

You agree not to use our service to:

  • Upload any content that is unlawful, harmful, or offensive
  • Upload photos of individuals without the consent of their parent or legal guardian
  • Attempt to interfere with, disrupt, or gain unauthorised access to our systems or servers
  • Use automated systems or bots to access our service
  • Resell or commercially exploit any part of our service without prior written consent

We reserve the right to suspend or terminate access to our service for any user who violates these terms.

7. Limitation of Liability

  • Our service is provided on an "as is" and "as available" basis. While we strive to ensure high-quality products, we do not guarantee that our service will be uninterrupted, error-free, or that the results will meet your expectations in every respect.
  • To the maximum extent permitted by law, MemoryTales Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our service.
  • Our total liability for any claim arising from your order shall not exceed the amount you paid for that order.
  • Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by English law.
  • These Terms do not affect your statutory rights as a consumer under UK consumer protection law.

8. Cancellation and Refunds

As our products are personalised and made to order, the standard 14-day cooling-off period under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 does not apply. For full details on our refund and returns process, please see our Refund & Returns Policy.

9. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or your use of our service shall be subject to the exclusive jurisdiction of the courts of England and Wales.

If you are a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these Terms affects your rights as a consumer to rely on such mandatory provisions of local law.

10. Severability

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our service after changes have been posted constitutes your acceptance of the revised Terms.
